These Terms of Use (“Terms”) govern your access to and use of Event Capsule (“Event Capsule,” “we,” “our,” or “us”).

By using Event Capsule, you agree to these Terms. If you do not agree, do not use the service.

1. What Event Capsule does

Event Capsule lets hosts create private event photo capsules and optional digital invitations. Hosts can set an upload window, reveal time, photo limits, RSVP settings, and invite guests using a QR code, event code, or link. Guests can RSVP when enabled, upload photos during the upload window, and access the gallery at the selected reveal time.

2. Beta status

Event Capsule is currently in beta. During beta, the service may be free to use, features may change, and some functionality may still be improved or adjusted.

We may introduce paid plans, limits, or additional features in the future.

3. Host responsibilities

Hosts are responsible for:

  • Providing an accurate email address and accurate event and RSVP details
  • Choosing event settings, including the upload window and reveal time
  • Sharing the QR code, event code, and event links only with appropriate people
  • Downloading event photos before expiry if they want permanent copies
  • Sharing and using downloaded photos responsibly
  • Making sure guests understand how photos will be collected, revealed, downloaded, and used
  • Using RSVP names, email addresses, attendance details, dietary requirements, and messages only for legitimate event planning and communication
  • Providing appropriate notice and obtaining any permission required before requesting dietary or other sensitive information
  • Making sure they have appropriate permission to collect, view, download, and share event photos where required
  • Not uploading, encouraging, or inviting uploads of illegal, harmful, or rights-infringing content

4. Guest responsibilities

Guests are responsible for:

  • Uploading only photos they have the right to share
  • Respecting the privacy and rights of others
  • Using event links only as intended
  • Not uploading harmful, illegal, explicit, abusive, or rights-infringing content
  • Understanding that uploaded photos may become visible in the event gallery after reveal
  • Providing accurate RSVP information and keeping private RSVP-management links confidential
  • Avoiding unnecessary sensitive information in optional dietary or message fields

5. Event links and access

Event Capsule is designed for private event sharing, but event links and event codes can be forwarded or shared by others.

Anyone with a valid guest link or event code may be able to access guest-facing event pages. Hosts and guests are responsible for sharing links carefully.

Host-only features require host verification. Private RSVP-management links act as access credentials for an individual response and should not be forwarded or shared. Anyone who obtains a valid link may be able to view or change that response until RSVP changes close.

6. Uploaded content

You retain ownership of photos and content you upload.

By uploading content to Event Capsule, you grant us permission to store, process, display, transmit, and make that content available as needed to provide the Event Capsule service.

You must not upload content that:

  • You do not have the right to upload
  • Violates someone else’s privacy, publicity, copyright, or other rights
  • Is unlawful, harmful, abusive, harassing, hateful, exploitative, or threatening
  • Contains malware, viruses, or code designed to disrupt the service
  • Is sexually explicit or otherwise inappropriate for an event photo-sharing service
  • Violates applicable law

We may remove content, restrict access, or suspend use if we believe content or activity violates these Terms or creates legal, security, privacy, or safety risk.

7. Photo privacy and reveal

Event Capsule is designed so the shared gallery remains sealed until the reveal time selected by the host. After reveal, guests with the event link or event code may be able to view the event gallery.

New guest photos are stored privately and displayed through temporary signed URLs when access is allowed. However, no system is perfect, and event links should still be shared carefully.

8. Photo and RSVP data availability and retention

Event photos are available for 30 days after the reveal time. It is the host’s responsibility to download photos before they expire if permanent copies are wanted.

Event Capsule may automatically and permanently delete photos after the retention period ends. Hosts may also permanently delete selected photos or all event photos earlier after reveal.

Downloading photos does not stop automatic deletion. Deleted or expired photos may not be recoverable, and deletion cannot be undone through Event Capsule.

RSVP responses and related activity remain associated with the event while needed to provide RSVP management, verified-host reporting, security, and support. They are deleted if the parent event is deleted. Until automated RSVP-retention deletion is available, guests and hosts may contact us to request correction or deletion, subject to appropriate verification and any limited retention required for legal, security, or operational purposes.

9. Downloads and sharing

Hosts may be able to download event photos as a ZIP file. Hosts are responsible for how downloaded photos are stored, used, and shared after download.

Event Capsule is not responsible for photos after they have been downloaded, copied, or shared outside the service.

10. Service emails and calendar invites

Event Capsule may send service emails needed to operate an event, including:

  • Verification codes
  • Event recovery emails
  • Gallery links
  • Invite details
  • Calendar invite attachments
  • Photo-expiry reminder emails
  • RSVP confirmations, private management links, response-change confirmations, and eligible host notifications
  • Deletion confirmation emails if that feature is introduced

By using the service, you agree that we may send these emails as part of providing Event Capsule.

RSVP changes close one hour before the event start time. Guests must use their private management link to change a submitted response; submitting the same email again does not overwrite an existing RSVP.

RSVP information is separate from photo-upload guest access and does not create an upload account, consume an upload-plan guest slot, or grant access to host, gallery, slideshow, or photo-management features.

11. Payments

Paid plans and add-ons are processed through Stripe. Prices and purchase details are shown before checkout, and beta or promotional codes may sometimes be offered.

Event Capsule does not directly store full payment card details. Any refund eligibility will be handled according to the terms shown at purchase or any separate refund policy that applies.

12. Photo limits and usage limits

Events may have limits on:

  • Number of guests
  • Number of photos per guest
  • Total photo count
  • Storage duration
  • RSVP attendee and plus-one limits
  • Upload window

During beta, limits may change as we test and improve the service.

13. Prohibited use

You may not:

  • Use Event Capsule for unlawful purposes
  • Attempt to access host dashboards, another guest’s RSVP, or event data without permission
  • Attempt to bypass security controls, host verification, signed URLs, or access restrictions
  • Scrape, enumerate, or mass-download data without authorization
  • Abuse verification, RSVP, or invite email features
  • Upload malicious files or code
  • Interfere with the security, stability, or operation of the service
  • Use the service to harass, spam, impersonate, or harm others

14. Service availability

Event Capsule is provided on an “as is” and “as available” basis. We aim to provide a reliable service, but we do not guarantee that the service will always be available, uninterrupted, secure, or error-free.

15. Limitations and data availability

We aim to store and make photos and RSVP features available during their intended periods, but we do not guarantee that photos, RSVP responses, event data, links, downloads, or galleries will always be available without interruption or error.

Event Capsule is not responsible when a host does not download photos before expiry. Deleted or expired photos may not be recoverable.

Event Capsule is not responsible for copies that hosts or guests have already downloaded, copied, or shared outside the service.

16. Third-party services

Event Capsule relies on third-party providers for hosting, database, storage, DNS, email delivery, payment processing, and related infrastructure. We are not responsible for outages, interruptions, failures, or changes caused by third-party providers.

17. Changes to the service

We may change, suspend, limit, or discontinue parts of Event Capsule at any time, especially during beta.

18. Limitation of liability

To the maximum extent permitted by law, Event Capsule and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of photos, data, profits, goodwill, or other intangible losses arising from your use of the service.

19. Disclaimer

Event Capsule is provided without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by law.

20. Termination or restriction

We may suspend, restrict, or terminate access to Event Capsule if we believe you have violated these Terms, created risk for the service or others, or used the service in an abusive, unlawful, or unsafe way.

21. Governing law

These Terms are intended to be governed by the laws of Ontario, Canada and applicable Canadian laws, unless a different law is required by applicable consumer protection rules.

22. Changes to these Terms

We may update these Terms as Event Capsule evolves. If we make material changes, we will update the “Last updated” date above.
